General Legal Terms and conditions for booking the Conference
§1. Purview
The following general terms and conditions govern the contractual relationship between the seminar/conference participant (hereafter „event“) and the Municipiality of Helgoland. Deviating general terms and conditions of the participant do not apply.
§2. Registration/confirmation of registration
You may register via the internet, fax, e-mail or by phone. Your registration will be confirmed by our return e-mail, with the written confirmation being legally binding.
§3. Performance
The registration fee is per person and event date, plus mandatory sales tax.
It includes event documentation, lunches, festive dinner, if booked, all beverages and snacks during breaks, and presentations. Municipiality of Helgoland reserves the right to substitute the announced speakers with others and to make necessary changes to the event schedule whilst maintaining the overall character of the event. If the event cannot be held due to acts of nature, the speaker being hindered, malfunctions at the venue or due to insufficient attendance, participants will promptly be informed. Cancellation due to insufficient attendance will be announced no less than 60 days prior to the event. In this case the event fee will be reimbursed. Claims for compensation of travel costs and accommodations as well as loss of salary is excluded.
§4. Due date and payment, default, offsetting
The registration fee is due upon receipt of invoice. If the participant is in payment default, Municipiality of Helgoland shall be entitled to charge default interest in the amount of 5% above the base lending rate (§ 247 Para.1 German Civil Code) p.a. In the event Municipiality of Helgoland is able to substantiate higher damages for default, said may be asserted. The participant is likewise entitled to substantiate damages were not at all incurred or were significantly less than claimed by Municipiality of Helgoland. Payment is made on account. Invoices are submitted in form of PDF. Payments cannot be sent in form of cash or check; Municipiality of Helgoland assumes no liability in the event of loss. The participant can only offset against claims established as final and absolute or acknowledged by Municipiality of Helgoland in writing. The participant shall only be authorised retaining lien provided said counter-claim is based on the same contractual relationship.
§5. Travel costs & accommodations
Any accommodations and travel costs are not part of the event. Municipiality of Helgoland will provide support with booking but expressly does not act as tour operator.
§6. Copyrights
Seminar documentation is copyright protected. Any duplication, transfer or other utilisation of event documentation requires the express written approval of the Municipiality of Helgoland.
§7. Liability
The events are carefully prepared and held by qualified speakers. The Municipiality of Helgoland assumes no liability for the topicality, correctness and completeness with respect to the seminar documentation and performing the event.
§8. Applicable law, place of jurisdiction and place of fulfilment
The German law under exclusion of the CISG applies. Where permissible by law, the place of fulfilment and place of jurisdiction is agreed to be Hamburg.
§9. Cancellation right for customers
You have the right to withdraw the application in writing within 14 days of receipt of the confirmation of registration without any reason, if a booking is made before 30th March 2019. Cancellation fees will not be charged. To meet the deadline, the timely dispatch of the revocation is sufficient to the following address: Community Helgoland, Lung Wai 28, 27498 Helgoland. This right of revocation does not exist if the booked event took place and the participant took part in it.
§10. Program changes
Changes or deviations of individual event services from the contents of the event agreement necessary after the contract has been concluded, and which were not which were not caused by use against good faith, are permitted provided the changes or deviations do not significantly impact the overall layout of the event or change the character of the event.
§11. Data protection
The Municipiality of Helgoland protects your personal information. The Municipiality of Helgoland will treat the information provided by the registrant as confidential. We will use the data collected during the ordering process and use of our offer within the applicable legal limits for the purpose of performing our services and to provide you with information about additional services offered by us and our partner- or group companies, similar to services you have previously used, by post or by e-mail. In the event such data is transmitted to countries without adequate data security levels for the purpose of utilising such data, we will provide adequate safeguards to protect the data. We will further utilise your data provided you consented to such use.
